Smaragd Deck guarantee
If installed and maintained in the correct manner according to the Smaragd Deck installation and maintenance instructions, Smaragd Deck comes with a 25-year guarantee against rot, structural decay, cracking, splitting, splintering and termite damage for the original owner (purchaser) and the first person to whom ownership is transferred, for as long as the house is the property of that person. Each purchaser of a Smaragd Deck product is personally responsible for determining the suitable use and the safety for each application of the product.
Every Smaragd Deck purchaser must obey local construction and safety regulations with regard to the special requirements for attaching appendages to government buildings and must also ensure that the installation conforms to the manufacturer’s guidelines.
Guarantee limits
Bekol International BV shall bear no liability for faults, damage or other unacceptable conditions as the result of:
| (A) |
installation directly on top of a concrete floor, installation directly on top of the ground, installation directly on top of other decking, or an installation which restricts good ventilation from above, below or from the sides; |
| (B) |
neglecting to leave a space of at least 3mm between each board for water drainage, maintenance and ventilation; |
| (C) |
stains by mould or mildew, wood bleeding, chalk, water rings, food, organic material, pets or paint; |
| (D) |
the settling, shrinking, or disturbance from other unacceptable conditions of the frame of the substructure, including incorrect mounting on the house or building; |
| (E) |
Smaragd Deck that is not laid with the correct slope; |
| (F) |
unapproved surface finishing treatments applied on the deck; stains from galvanised or non-coated screws, or |
| (G) |
use as construction material; |
| (H) |
incorrect handling, storage, misuse or negligence by the purchaser or by third parties |
| (I) |
variations or changes in the colour of Smaragd Deck – (all colours will fade by at least 10%). Bekol International BV bears no responsibility for the costs of removing or treating faded decking). |
Should you perceive defects in the Smaragd Deck for whatever reason, do NOT install it. Instead, contact your dealer. Bekol International BV is not liable for claims which arise after the installation of a product with visible defects. Mould or mildew is not a production defect and is NOT covered by this guarantee or any other designated guarantee.
Transferability of the guarantee
This guarantee may be transferred once, as indicated in this paragraph.
In the event that the original consumer, at whatever time during the guarantee period, sells the building in which the Smaragd Deck product has been installed, then the guarantee can be transferred to the buyer. However, in order to actually obtain this guarantee, a guarantee transfer card must be filled in and sent back to Bekol International BV within 30 days after the date of the transfer, together with the transfer fee of fifty euros (€50.00) payable to Bekol International BV.
Claims processing and information
The manufacturer’s liability for this product under this guarantee is limited to the person and is exclusively for the replacement of the defective Smaragd Deck product. In no case is the manufacturer liable for labour, installation, freight, taxes or any other invoiced item related to the defective product.
The manufacturer is not liable for indirect, incidental, consequential, model-based or any other damage of whatever sort, whether or not the claim is based on contract theories, guarantee, negligence, criminal offences, severe liability or otherwise.
In the event of any dispute regarding the performance of the product, the purchaser will bear the responsibility of proving that the product has been installed, finished and maintained in the correct manner according to the standards of the manufacturer’s installation requirements. In order to register a claim under this guarantee, the original purchaser (or authorised seller) must supply a proof of purchase, plus a photo of the defective product together with a written description to Bekol International BV, Industriestraat 5E, 7122 AP, Aalten.
The manufacturer has the right to investigate each claim.
When a claim has been verified, the manufacturer shall arrange the provision of a replacement product.
The guarantee will not be changed or reviewed except by means of a written declaration signed by the manufacturer and the Smaragd Deck purchaser.
No dealer or other person or entity is authorised by the manufacturer to make statements or representations which refer to the performances of Smaragd Deck products that are not stated in this guarantee.
The manufacturer will not be bound by statements that are not contained in this guarantee.
The foregoing guarantee applies exclusively to the Smaragd Deck product.
